Introduction
Webside Holidays is a service offered by Webside Traveler SARL with a capital of 20,000 CHF - registered with the Fribourg Canton Trade and Corporate Register under the number CH-217-3540528-7 – Registered office: Route du Coutset, 18 1485 Nuvilly, Switzerland. Webside Holidays is a website for dissemination and promotion purposes. It offers a service for posting ads relating to vacations and tourism. Webside Holidays does not intervene in searches or in transactions, for example in the process of a renting a vacation home or a home exchange.
Posting Ads
Webside Holidays and its partners publish ads relating to vacations and tourism on their website. The owner of a real estate ad (advertiser) appearing on Webside Holidays attests that he is the owner of the property to be rented, or an official occupant in the case of a home exchange (or a duly authorized proxy), and authorizes Webside Holidays and its partners to post his ad in its entirety (text, photos, and videos) on all media, particularly for their own promotion. The advertiser certifies that he owns the copyrights to the photos and videos he supplies.
The Advertiser's Commitments
- He guarantees the accuracy of the information provided regarding his identity and the descriptions of the property.
- In the case of a vacation rental, he promises to update his calendar directly in his admin area, created for this purpose on Webside Holidays and to indicate the periods during which the property is rented as reservations come in. If this is not done, Webside Holidays reserves the right to withdraw the ad.
- In the case of a vacation rental, he pledges to add at least two photos of the interior or the external facade of his real estate property to his ad and he certifies that these photos faithfully represent the real estate property.
- In a home exchange ad, to update his ad so that it accurately reflects reality, especially as it concerns his destinations and possible travel dates.
- When he enjoys a free period for posting an ad, he consents to receive the Webside Holidays newsletter by e-mail each month. Once the free period is over, he may decide to stop this service at any time if he so wishes.
Providing Contacts
The advertiser will deal with the traveler of his choice as he sees fit without the mediation of Webside Holidays. He pledges not to use the information that Webside Holidays may give him about a member, particularly for commercial/marketing purposes.
Content moderation
Webside Holidays cannot in any case be held responsible for the content of or the lack of information in posted ads, or ads not being updated because advertisers write their ads themselves. It is therefore up to the traveler to check the accuracy of the information contained in the ads.
The images and videos are viewed after publication by our teams with the sole aim of complying the law on the protection of individuals. Webside Holidays reserves the right to refuse any element (ad, photo, video, or hypertext link) that it judges to be incompatible with its business or that may provoke third party complaints.
After verification, Webside Holiday also reserves the right to remove an ad, photo, video, or hypertext link that was the subject of a third party complaint, and any subscription fees shall be retained by Webside Holidays . Only the advertiser is liable through his ad and he explicitly pledges to release Webside Holidays of all liability vis-à-vis a third party.
Inaccurate Content
If an error linked to IT programming or translation slips into the presentation of the ad content through the fault of Webside Holidays, its liability cannot exceed the total paid for the ad by the advertiser.
Ad Posting Period
Paid ads are posted once we receive payment for the subscription plan you choose. Publication stops automatically at the end of the subscription period. There is no automatic renewal.
The ad is kept for a one year period in the memory of the site's servers, in order to facilitate a possible future renewal. The posting of ads, both paid and free, can be suspended by the advertiser at any time if he so wishes. This suspension does not entitle you to any reimbursement or extension of the ad. When the ad expires on the date that was initially set, it will be saved for a period of one year in the memory of the site's servers, in order to facilitate a potential renewal.
Hypertext Links to Personal Web Pages
In exchange for a backlink to our website, Webside Holidays can put a hypertext link to the advertiser's web page on the ad, provided the subscription plan allows it and only after its verification. Since permanent ongoing verification of these personal pages cannot be performed, the owner releases Web Holiday of all responsibility for their content.
Access to the Website
The Webside Holidays website is accessible 7 days a week, 24 hours a day, except in the case of force majeure or during periodic maintenance. If a technical problem makes access to its services impossible, Webside Holidays pledges to do everything possible to implement all technical solutions aimed at restoring access to its services. Webside Holidays is bound by an obligation of means but cannot be held responsible for the consequences of a service interruption outside of its control.
Data Protection
Protecting your personal data is a priority for us and we want you to feel safe when you visit our website. We process the personal data collected during your visit to our website in accordance with the legal provisions in force. Webside Holidays may contain links to other websites, which this data protection policy doesn't cover.
Collection and Processing of Personal Data
Webside Holidays respects your privacy and your personal environment. As standard procedure when you visit our website, our web server records the name of the internet service provider through which you came to our site, the pages that you have visited, the date as well as the length of your visit.

You may choose at any time to stop receiving this type of message from Webside Holidays by informing us at any time so that we can block the use of your personal information.

The cookies used by Webside Holidays are in no way used to gather personal information about visitors. Webside Holidays uses temporary session cookies to help navigate the site. Webside Holidays Rules of Use
All content on this site is only available to members and visitors of Webside Holidays with the sole and unique purpose of helping people enter into agreements regarding home exchanges, vacation rentals, or cultural exchange.
This site functions as a club organized by its members. Information is therefore private and not in the public domain. No one, whether a member or a visitor, is authorized to use this site for any type of solicitation or for a commercial purpose. Collection and storage of information of any type coming from this site is prohibited. Any violation of this rule will be subject to legal proceedings with a fine of at least 1000 euros per member contacted for commercial purposes.
Conduct of Members
Members pledge not to provide inaccurate or misleading information relating to their use of the site. Members shall maintain a courteous and respectful relationship with other members. Members pledge not to use this site to violate any laws. Members pledge not to upload or transmit files that contain viruses, corrupted parts, Trojan horses, malicious code, or any other program that can damage third party computers or help them obtain access to areas reserved for members of Webside Holiday's management. Members pledge not to expose Webside Holidays to any legal violation that would put it at risk for civil or criminal sanctions.
Compensation
You pledge to compensate Webside Holidays for any legal or lawyer's fees if you violate your part of these terms and conditions of use or any applicable law that would lead to a claim being lodged against Webside Holidays by a third party. You pledge to reimburse any director, shareholder, or employee of Webside Traveler if you could be held liable for any damages or injuries resulting from your use of the site, including but not limited to:
- any claim for damages or injuries resulting from a property owned by you
- any claim for damages or injuries resulting from a transaction where you are one of the parties
- a violation of the present terms and conditions
- a claim resulting from a violation by you or any other person using your computer of any law or rule within the context of using this site
- any inaccurate information you have provided
- any breach of an agreement you have entered into
You pledge to pay all costs, including reasonable lawyer's fees, in the case of any legal proceedings or a legal action within the framework described in the present terms and conditions of use.
